IDENTIFICATION: Guest must make reservations in the full name that is listed on their passport that they will use for travel. If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable.
PAYMENTS: Reservations can be made online with major credit cards.
REFUNDS: All payments to Exhale Travel & Events are non-refundable and non-transferable. This is because Exhale Travel & Events has contractual agreements with hotels, airlines, and other vendors that will not allow up to obtain refunds. This way, we can keep out package prices competitive and allow you to make monthly payment installments on your vacation.
CHARGEBACKS: Before filing a dispute with your bank, please call Exhale Travel & Events at (469) 649-5730 or contact us via email at info@exhaletravelevents.com to discuss account resolution. Filing chargebacks could result in your reservation being cancelled and may prevent future travel with Exhale Travel & Events, LLC.
ROOMMATE PAIRING: Roommate pairing may be available for some vacations. You will need to specify BEFORE making any payments if you would like to be paired with a roommate. Your pairing will be confirmed at least 45 days before trip departure date.
PASSPORTS AND VISAS: Passengers are responsible for ensuring they have the accurate travel documents and must check with the respective consulates or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided in the travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. Exhale Travel & Events does not provide or validate travel requirements for Non-US citizens. We strongly suggest all cruise passengers have a valid passport in their possession while cruising and make copies to leave at home with a non-traveling person as well as to carry with you on excursions.
TRAVEL INSURANCE: We strongly suggest Travel Insurance that provides coverage for Trip Cancellations, Interruption, Baggage Loss and more. You are required to select and purchase travel insurance yourself for domestic and international tours.
TRAVEL DOCUMENTS: Full payment is required at least 60 days before travel. Travel documents will be sent to you via email at least 30 days before travel.
CHILDREN: All children under 18 must be accompanied by an adult. The minimum age for children on tours is 16. Unless specified as a “family vacation/tour”. Accompanying adults are responsible for the safety of their children. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years old will be traveling with an adult other than his/her parents or with only one parent, a notarized letter written by the parents, or non-traveling parent, granting authorization to travel, including the dates of travel, should be carried.
PRICES: All prices listed are per person and based on double occupancy unless otherwise clearly specified. Pricing does not include personal items such as food, beverages, water, laundry service, private car services, spa services (unless notated in the vacation package), passport/visa fees, insurance, foreign port taxes (unless notated in the vacation package). Prices are accurate at the time of publication, however, airfares and classes of service may fluctuate. In case of human or digital error, Exhale Travel & Events reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase, provided Exhale Travel & Events receives a written cancellation notice within five (5) days of the price increase notification. We will notify all travelers of any changes to itinerary and price increases via email as soon as they are made notice to our offices.
AUTOMATIC PAYMENTS/PAYMENT OPTIONS
Final payment is due at least 60 days before travel. You will be automatically enrolled in our automatic billing plan upon booking. This allows for a more relaxed, streamlined approach to ensuring your vacation is fully funded before the deadline. When you book, we’ll calculate an evenly divided automatic billing plan for you, and you will know in advance on the day of every month that your payment will be processed. Your initial deposit is due at the time of booking, and your future payments will be charged according to the schedule you see on your invoice.

DEPOSIT: A deposit is due at the time of reservation. All deposits are non-refundable and non-transferable. All reservations (except where specified) will require a deposit, and the amount due and the monthly payment plan will be clearly noted on your communication.
FULL PAYMENT: All reservations can be paid in full at the time of booking if the vacation still has space.
LATE PAYMENT: If there is any outstanding balance by the Final Payment Due date listed on your invoice, a late fee of $150 will automatically be added to your invoice one day after your final payment date.
RESERVATION REINSTATEMENTS: If your travel reservations have been canceled due to non-payment and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $250 will be added to your invoice and must be paid in advance to apply for reconfirmation of services.
LAST MINUTE RESERVATIONS: All reservations must be made no later than 60 days before departure. If requested services cannot be confirmed, payment will be refunded. If services are confirmed, final payment is due within 24 hours, and all applicable cancellation penalties will apply.
FORM OF PAYMENTS: Exhale Travel & Events accepts all major credit or debit cards (Amex, Discover, Mastercard, Visa).
REFUNDS: All payments to Exhale Travel & Events are non-refundable and non-transferable. This is because Exhale Travel & Events has contractual agreements with hotels, airlines, and other vendors that will not allow us to obtain any refunds. This allows us to keep our prices competitive and allows for monthly payments on your vacation.
CANCELLATIONS: Once reservations have been made, cancellations will only be accepted in writing. Email your cancellation request to info@exhaletravelevents.com with your invoice number, full name, and travel date. Once your email has been received, we will begin our cancellation process and send an email confirmation back to you. If you do not receive any updates within 48 hours, please call (469)649-5730 to ensure your information was received.
RESERVATION NAME CHANGES: Name changes due to incorrect information being provided will incur a $250 per person charge plus any additional supplier fees. Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with anther traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Name Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.
COVID-19 WAIVER OF LIABILITY
In 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Centers for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering, and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC webpage at www.cdc.gov
Waiver and Release of Liability:
1. Acknowledgment of Risk:
I, the undersigned traveler, acknowledge that traveling during the COVID-19 pandemic involves inherent risks. I understand that the nature of the virus and the potential for exposure cannot be completely eliminated, even with precautions and safety measures in place.
2. Information Provided:
I confirm that Exhale Travel and Events has provided me with the most current and accurate information available regarding COVID-19, including guidelines and recommendations from health authorities. I have been informed about the potential risks associated with traveling during the pandemic.
3. Protective Measures:
I understand that Exhale Travel and Events has communicated the protective policies and practices of the vendors and suppliers included in my travel itinerary. These measures are designed to mitigate the risk of COVID-19 exposure, but I recognize that there are no guarantees.
4. Personal Responsibility:
I agree to adhere to all COVID-19 safety protocols as outlined by Exhale Travel and Events, as well as those mandated by local, regional, and national health authorities during my travel. This includes, but is not limited to, wearing masks, practicing social distancing, and following hygiene practices.
5. Release of Liability:
I hereby release and hold harmless Exhale Travel and Events, its affiliates, employees, agents, and partners from any and all claims, demands, actions, or causes of action related to or arising from my travel, including but not limited to any claims related to exposure to COVID-19.
FORCE MAJEURE
There may be times when either party is unable to perform, or complete performance, under the travel contract for reasons out of each other’s control. These are called force majeure events and, if they occur, make performing under the contract inadvisable, commercially impracticable, illegal, or impossible. Events that may trigger this provision include but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military action, strikes of other labor activities, criminal or terrorist activities of any kind, or the threat thereof, pandemics, epidemics, illnesses or health conditions prevalent in the area of travel, earthquakes, hurricanes, lightning, and explosions, unexpected legislation or any other event outside of the reasonable control of either party.
In the event that a force majeure event occurs, the parties will look to and follow the cancellation policies of the suppliers, what is stated in the travel proposal, and these terms and conditions. Any changes to those policies are at the sole discretion of the supplier (if applicable) and Exhale Travel & Events. Passengers will be informed of their options in a force majeure event occurs.
TRAVELERS WITH DISABILITIES
We want your vacation and/or tour with Exhale Travel & Events to be enjoyable and successful. We recommend that you select a vacation that is suitable to your physical capabilities. If you should require any form of assistance, including travelers with physical disabilities and sight or hearing impairments, you are required to notify Exhale Travel & Events prior to making a reservation for review and our agreemetns. In addition, any participants with disabilities or impairments must be accompanied by an individual responsible for providing those services. Tour managers, guides, drivers, or other tour, hotel and ship personnel are not able to provide such assistance. In order to participate in escorted tours, passengers must be able to understand and follow instructions given by the Tour Directors at all times, both for the successful operation of the tour and well as for their personal safety. Exhale Travel & Events reserves the right to reject participation or remove any individual from a tour if notification was not provided and/or when, in our sole judgement, continued participation would hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the passengers sole responsibility. Escorted tours can be fast-paced, often requiring lengthy walks over uneven terrain. In the interests of group harmony clients should be able to maintain the pace of the tour. Clients with special needs may be better served independently. Exhale Travel & Events will do our best to suggest other options of touring and vacations based on specific requirements.
Wheelchairs/Walkers/Mobility Devices: USA Vacations/Tours/Events: Pursuant to the Americans with Disabilities Act (ADA), Exhale Travel & Events seeks to accommodate disabled travelers to the extent possible and consistent with the specific itinerary. However, you may find that certain itinerary features may not be accessible to the extent that you require a wheelchair, scooter, or other special equipment to participate. We cannot provide individual assistance to travelers with wheelchairs or other mobility devices. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters. Passengers are required to advise Exhale Travel & Events of their accessibility requirements prior to booking in order for Exhale Travel & Events to determine if reasonable accommodations are available. Exhale Travel & Events will make effort to accommodate special access needs but does not guarantee that it will be able to do so in all cases.
International Tours: Hotels, Sea, and River Cruises outside of the United States are not required to comply with ADA requirements and, therefore, may not have ramps, wide entryways, or elevators to accommodate disabled passengers or devices such as wheelchairs, walkers, and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers, and motorized scooters may not be taken aboard motor coaches and river cruises.
Service Animals: Service animals cannot be accommodated on international escorted tours. Passengers on the USA escorted tours/vacations/events who require a service dog because of a disability should check with Exhale Travel & Events prior to booking. Please note: Any fees associated with housing/boarding a service animal in a hotel will be the responsibility of the traveler and will not be included in our pricing.
AIRLINES
Exhale Travel & Events is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notices. Exhale Travel & Events is not responsible for penalties incurred for tickets, international or domestic, not issued by Exhale Travel & Events due to schedule and/or flight changes. Travelers are responsible for ensuring airline itinerary is in alignment with the scheduled tour/vacation itinerary. Exhale Travel & Events is not responsible for time loss, delays or inaccurate booking on behalf of the traveler. You will be notified immediately if there are any changes to our itinerary which will cause you to change the timing of your flights. Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked, even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, Exhale Travel & Events will require immediate and full payment of airfare if booking airfare is our responsibility for the specific itinerary. This situation overrides invoice terms and conditions and payment due dates. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the safe flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the passenger.
Airline Tickets: Exhale Travel & Events airline tickets will be issued electronically approximately 30 days prior to departure and are fully non-refundable.
Airline Seat Assignments: The airlines bear the sole authority of assigning seats on group flights. All Exhale Travel & Events airline contracts are for economy-class seats only. If you require another class of service, you may consider purchasing your own flights and purchasing your land-only package from Exhale Travel & Events.
Airline Frequent Flier/Mileage Programs: Exhale Travel & Events is not responsible for updating, documenting, or handling in any form airline frequent flier or mileage programs. Should you have questions about obtaining any rewards for your flights, please contact the airline directly with your itinerary information. In the event that you would like to use your airline rewards to book your flight, please contact the airline directly and book a “land only” vacation with Exhale Travel & Events.
Contact Information: Pursuant to TSA Secure Flight requirements, passengers are responsible to provide Exhale Travel & Events with their name as it appears on their passport (or other government-issued identification when traveling), date of birth, gender, address, phone number, email and fax data for all passengers. Passengers must ensure that name are correctly listed on their invoices. Exhale Travel & Events will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information.
Airline Name Changes: Any name changes, including minor spelling corrections, may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking feed which may be as much as the full value of the airline ticket plus a $250 revision fee per change. Exhale travel & events will not be held responsible for the denial of service by a carrier due to any name discrepancy. Name changes must be advised in writing at info@exhaletravlevents.com
Airline Taxes & Fuel Surcharges: If you purchased airfare, airline taxes, and fuel surcharges are included. Prior to the completion of full payment, there is a potential for a price increase(s) due to increases in government-levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are full non-refundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes are indicated in our package presentation and pre-departure documentation.
Schedule Changes: In the events of an airline schedule change, Exhale Travel & Events will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. Exhale Travel & Events is not responsible for schedule changes, including, when applicable, changes in routing and/or the number of stops in the itinerary. Exhale Travel & Events is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airlines it is the passengers responsibility to advise Exhale Travel & Events of amended flight details in writing at info@exhaletravelevents.com Exhale Travel & Events cannot be held responsible for land services, including arrival and/or departure transfers if flights are changed without its knowledge.
HOTEL ACCOMMODATIONS
All rooms requested are standard twin-bedded (2 single beds) rooms with private facilities unless you have specifically requested a king/double size bed or the hotel accommodations are as such. Please understand we can make a bed type request on your behalf however bed types are subject to availability.
Room selection in call cases is strictly at the discretion of the hotel’s management on a run-of-house basis.
Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate room size.
Although available at most 4–5-star hotels, the use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air-conditioning was introduced. Air -Conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are not negotiable and based on Exhale Travel & Events agreements with its suppliers. Hotel check-in time is generally not before 3PM and check-out time is usually before Noon. It is the traveler’s responsibility to ensure adequate arrangements for accommodations have been taken into considerations when a late-night flight is being used. We are not responsible offer any additional accommodations during gap time from hotel check-out to flight departure. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference I the cost of those accommodations.
Hotel & Cruise Profiles: Exhale Travel & Events hotels and cruise ship profiles are based upon information provided to its agency by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. Star ratings may differ from country to country. Exhale Travel & Events does its best to maintain current information; however, it is not responsible for ay inaccuracies, changes in description details or amenities, or images provided by third parties.
MEALS
As specified in each itinerary. Meals are based on the hotel’s or restaurant’s buffet or set menu offerings. In general, beverages are not included unless specifically stated. Although Exhale Travel & Events cannot make guarantees, every effort will be made to honor special dietary requests submitted in writing at least 6 weeks prior to departure at info@exhaletravelevents.com
TRANSFERS All Transfers are provided as indicated on the itinerary by car, minibus or motorcoach. Please Note: Not all itineraries will have included transfers, in which case the traveler will be required to self-book this accommodation. Should the passenger deviate from the schedule itinerary that includes transfers, they will be held responsible to book their own transfers. For passengers with included transfers: Your arrival transfer is guaranteed for up to two (2) hours from your scheduled arrival time in order to compensate for minor delays. Exhale Travel & Events or the transfer company will not be responsible for flight delays, for any reason, beyond two (2) hours from your originally scheduled arrival time. In case of a delay, whether due to flight delay, immigration, and customs, or time spent reporting baggage damage or loss, it will be the passenger’s responsibility to make other transfer arrangements, such a s a taxi. Transfer costs are not refundable, and any additional expense will be passenger responsibility. The cost of a transfer is more expensive than hiring a taxi, as Exhale Travel & Events transfers include round trip service or “dead-leg” meaning that our driver must come to the airport, hotel, or pier only to pick you up and could lose a one-way fare. Oftentimes, the places of call, including airports, seaports, and hotels, demand entrance and parking fees, where drivers may have to wait for up to an hour. Exhale Travel & Events transfer drivers, while not employees of Exhale Travel & Events are reliable, welcoming and accurate regarding location and answering questions.
Sightseeing & Itinerary: Exhale Travel & Events vacations/tours/events are designed to accommodate groups and individuals. The size of the motor vehicle will be based on the number of participants and varies depending on if it is a private or public tour. Times for tours/events could be subject to change based on various situations such as weather or duration of the tour/event. You are responsible for arriving on time for all scheduled package components, flights, and cruises. Late arrival could be considered as a “no-show”, in this case, you will not be eligible for a refund for the unused service(s). Persons requiring any assistance or who have any form of disability should refer to the section “Travelers With Disabilities.”
Depending on various dates such as religious holidays, national celebrations, some sites/monuments may be closed. On these occasions, touring itineraries may be amended to reflect these closures. Please note: There may be last minute variations or changes to the itinerary based on holidays, unforeseen circumstances, weather conditions. We reserve the right to adjust the sequence and/or substitute any parts of the vacation/tour/event with a similar service and/or accommodation and this adjustment does not constitute an endorsement of any specific service provider, and the decision to participate in any such activities should be made independently and with due consideration.
Group Harmony: To ensure the desired group collaboration, Exhale Travel & Events reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, invidieduals who are intoxicated and/or under the influence of drugs, belligerent or disrespectful towards anyone including but not limited to other travelers, staff, and/or supplier/vendors leading to a negative experience for the remainder of the group. Expenses, including cancellation fees, and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable and could also result in being banned from booking with Exhale Travel & Events in the future.
Individual Etiquette: It is our expectation that travelers patronizing our preferred suppliers/vendors uphold the respect and dignity of Exhale Travel & Events. In the event that behaviors such as disrespect, belligerent communication or actions, violence, intoxication of alcohol and drug-use causes a traveler to be removed or banned from a vacation, cruise, tour, airlines, hotel, restaurant, tour vehicle or such, Exhale Travel & Events will not be held responsible, nor issue refunds. We also reserve the right to disengage with the passenger for future accommodation requests.
CRUISES
Ship & Itinerary Changes: Cruise itineraries and ships are subject to change without notice. Cruise ships may be chartered and/or departure dates canceled, in which case all monies will be refunded. Exhale Travel & Events takes no responsibilities for ship substitutions or itinerary changes imposed by a cruise line and is not responsible for any losses you may incur, including the issuance and/or cancellation of airline tickets or visa fees.
Medical Services: In the event that medical services are necessary, local services will be contacted. The resulting charges will be the responsibility of the passenger. Exhale Travel & Events and the cruise ship operator are not responsible for the services provided. Please also refer to the cruise lines terms and conditions regarding medical necessities/accommodations on their respective webpages and FAQs.
HEALTH REQUIREMENTS
Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Diseas Control (CDC) (www.cdc.gov) and/or the World Health Organization (WHO) (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by the clients health practitioner on a valid vaccination certificate which the client must carry for prof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy or mental illness should not participate in rigorous travel programs. Any persona arriving at the destination ill with an apparent fever or becoming ill during the tour will be removed from the group and directed to a local medical facility for diagnosis. Only upon clearance by an accredited medical facility will that individual be allowed to resume group travel. All cost associated with medical treatment and related expenses, such as additional hotel nights or transportation not included in the original itinerary will be passenger responsibility.
Individual Tours/Vacations/Events: The same applies and would be at the discretion of tour/hotel/cruise/resort management.
LUGGAGE
Airlines: Please check with the airline for specific requirements regarding carry-on and checked bags. Exhale Travel & Events is not responsible for cost associated with baggage fees including but not limited to excess luggage, weight charges, lost, or damaged.
Please Note: We recommend using luggage tags and/or airtags to identify your luggage. Exhale Travel & Events will not alter scheduled itinerary in the event of any luggage issues.
Escorted Tours: All Exhale Travel & Events escorted tour buses allow for one piece of luggage per person, plus a carry-on bag. Additional baggage may be subject to a handling charge. Exhale Travel & Events will not be responsible for any loss or damage t luggage and personal belongings. You must report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider.
Gratuities: Exhale Travel & Events strongly recommend providing gratuities to our service providers including drivers and tour guides. Please tip at your own discretion. You may find tipping guidelines on the web, however, we suggest a range of $5-$20 per day per person.
PASSENGER AGREEMENT: All clients of Exhale Travel & Events must complete a Passenger Agreement before travel. By doing so, you must also accept Exhale Travel & Event’s Terms & Conditions. Travel documents will not be released without a completed Passenger Agreement. Exhale Travel & Events reserves the right to cancel any booking and return deposits without a completed Passenger Agreement. The Passenger Agreement includes the Terms & Conditions, Release from Liability, Assumption of Risk and Binding Arbitration Clauses.
RELEASE FROM LIABILITY
Exhale Travel & Events LLC.; its shareholders, directors, officers, employees, and affiliates (collectively “Exhale Travel & Events) does not own or operate any entity which is to or does provide gods or services for your trip, including, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons are entities are independent contractors. As a result, Exhale Travel & Events is not liable for any negligent or willful act or failure to act of any such person or entity or of any other third party.
1.Acknowledgment of Risk: I understand that travel, tourism, and participation in events organized by Exhale Travel & Events involve inherent risks, including but not limited to, travel delays, cancellations, accidents, injuries, loss of personal property, theft, natural disasters, and illness.
2.Waiver of Claims: I hereby release, waive, and discharge Exhale Travel & Events, its employees, agents, representatives, and affiliates from any and all liabilities, claims, demands, actions, or causes of action, whether known or unknown, arising out of or in any way connected with my participation in any travel or events organized by Exhale Travel & Events. This includes, but is not limited to, any claims for personal injury, property damage, or loss, whether caused by the negligence of Exhale Travel & Events or otherwise.
3.Airline and Transportation Liability: I acknowledge that Exhale Travel & Events is not responsible for the actions, errors, or omissions of airlines, transportation companies, or any other third-party service providers. I understand that any issues related to flights, transportation delays, cancellations, or related services are to be addressed directly with the respective service providers.
4.Medical and Health Risks: I acknowledge the health risks associated with travel, including the potential for illness, disease, and other health-related issues. I assume full responsibility for my health and well-being during the course of my travel and agree to take all necessary precautions to protect myself.
5.Force Majeure: I understand that Exhale Travel & Events is not liable for any failure to perform its obligations due to circumstances beyond its control, including but not limited to, acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, and other force majeure events. In such cases, Exhale Travel & Events reserves the right to cancel, reschedule, or modify travel and event arrangements as necessary.
6.Personal Responsibility: I acknowledge that it is my responsibility to obtain appropriate travel insurance, medical insurance, and any other necessary coverage for my trip. I understand that Exhale Travel & Events strongly recommends obtaining comprehensive travel insurance to cover any potential risks.
7.Governing Law: This Release from Liability shall be governed by and construed in accordance with the laws of the jurisdiction in which Exhale Travel & Events is based. Any disputes arising out of or related to this agreement shall be resolved in the courts of that jurisdiction.
BINDING ARBITRATION
This Binding Arbitration Agreement ("Agreement") is entered into by and between the undersigned traveler ("Traveler") and Exhale Travel & Events ("Company"), with its principal place of business located in Texas. By booking travel services with the Company, the Traveler agrees to the following terms and conditions:

Agreement to Arbitrate: The Traveler and the Company agree that any and all disputes, claims, or controversies arising out of or relating to this Agreement, the services provided by the Company, or the relationship between the Traveler and the Company shall be resolved exclusively through final and binding arbitration, rather than in court.

Federal Arbitration Act: This Agreement shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16) and applicable federal arbitration law. The arbitration shall be conducted in accordance with the rules and procedures of the American Arbitration Association ("AAA").

Waiver of Right to Jury Trial: By entering into this Agreement, both the Traveler and the Company expressly waive their respective rights to a trial by jury and agree that arbitration is the exclusive remedy for any and all disputes, claims, or controversies that may arise between them.

Arbitration Procedures:

Initiation: Either party may initiate arbitration by providing written notice to the other party and filing a demand for arbitration with the AAA.

Selection of Arbitrator: The arbitration shall be conducted by a single arbitrator selected by mutual agreement of the parties. If the parties cannot agree on an arbitrator, the AAA shall appoint one.

Location: The arbitration shall take place in the county where the Company's principal place of business is located, unless the parties agree otherwise.

Discovery: The arbitrator shall have the authority to order reasonable discovery, consistent with the nature and scope of the dispute.

Decision: The arbitrator's decision shall be final and binding on both parties. The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award, including attorney's fees and costs, if provided for by law.

Costs and Fees: Each party shall bear its own costs and expenses of the arbitration, including attorney's fees, unless the arbitrator rules otherwise. The parties shall share equally the costs and fees of the arbitrator and the AAA.

Confidentiality: The arbitration proceedings and any related documents shall be confidential and shall not be disclosed to any third party without the express written consent of both parties, except as required by law.

Severability: If any provision of this Agreement is found to be unenforceable or invalid, the remainder of the Agreement shall remain in full force and effect.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Entire Agreement: This Agreement constitutes the entire agreement between the Traveler and the Company with respect to the subject matter herein and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
VOLUNTARY PARTICIPATION
I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or any trip which I may change to) and that I have read the description and details of the trip as it appears in the current Exhale Travel & Events website/social media platform/email relating to the trip, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards, rules, regulations and itinerary involved.
KNOWING AND VOLUNTARY EXECUTION
I have carefully read these Terms and Conditions and the booking information sections of this document and fully understand its contents. I am aware that this is a release of liability and a contract between myself and Exhale Travel & Events, and I agree of my own free will. By signing, I agree to these Travel Terms and Conditions and Exhale Travel & Events Release from Liability, Assumption of Risk, And Binding Arbitration Clause for myself, each member of my traveling party, and any minor children and/or service animals accompanying me.
PHOTOGRAPHIC RELEASE
Exhale Travel & Events may take photographs or videos of its trips or may ask clients to share photographs and videos from their trips, and trip participants grant Exhale Travel and Events permission to do so and for it to use same for promotional or commercial use without payment of any compensation to the participant.
USE OF WEBSITE, SOCIAL MEDIA, MOBILE COMMUNICATION
Agreement between Customer and Exhale Travel and Events: www.exhaletravelevents.com is offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein.
